These Terms of Use (“Terms”) govern your access to and use of intuitiv.space and any related sub-domains (the “Site”), operated by Intuitiv Spaces Inc. (“Intuitiv”, “we”, “us”). By accessing or using the Site, you agree to be bound by these Terms.

About Intuitiv

Intuitiv Spaces Inc. is a British Columbia corporation and a member of the Wenner Group of Companies. Intuitiv operates as a specialist consultancy providing technology design, project management, custom programming, and continuous engagement for ultra-luxury residences and superyachts.

Intellectual Property

All content on the Site — including text, graphics, photographs, logos, software, code, and design elements — is owned by Intuitiv Spaces Inc. or its licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any portion of the Site without our prior written consent. Limited personal, non-commercial viewing is permitted.

Acceptable Use

You agree not to use the Site for any unlawful purpose, and in particular agree not to engage in any of the following:

• Introducing viruses, malware, or other harmful code
• Scraping, harvesting, or otherwise extracting data from the Site by automated means without our prior written consent
• Using the Site for any fraudulent, misleading, or unlawful purpose
• Interfering with the Site’s operation or security
• Attempting to gain unauthorised access to any account, system, or network

Enquiries and Project Engagements

Submitting an enquiry through the Site does not create a consulting engagement. An engagement exists only when a written proposal is signed by both parties or a written service agreement is in effect. Pricing, scope, timelines, deliverables, warranty, and limitation of liability for consultancy services are governed by those separate agreements, not by these Terms of Use.

Third-Party Content and Links

The Site may contain references to third-party products, services, manufacturers, or websites. Inclusion of such references does not imply endorsement. Intuitiv is not responsible for the content, accuracy, or practices of any third party. Your interactions with third parties are solely between you and those parties.

Disclaimers

The Site is provided “as is” and “as available”. Intuitiv makes no warranties, express or implied, regarding the Site, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Case studies, project examples, and technical descriptions on the Site are illustrative. Outcomes for your specific project will depend on scope, site conditions, chosen technologies, and other factors — and are governed by a written proposal and service agreement, not by Site content.

Limitation of Liability

To the maximum extent permitted by law, Intuitiv Spaces Inc., its affiliates, and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Site — whether based on warranty, contract, tort, or any other legal theory.

To the extent liability cannot be excluded, Intuitiv’s total aggregate liability for any claim arising out of or related to the Site is limited to CAD $100.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death, personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Indemnification

You agree to indemnify and hold harmless Intuitiv Spaces Inc., its affiliates, and its officers, directors, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

Privacy

Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree that any dispute arising out of or relating to the Site or these Terms will be resolved exclusively in the courts of the Province of British Columbia, Canada, and you consent to the personal jurisdiction of those courts.

This governing law provision applies regardless of your country of residence. If you are located in a jurisdiction that prohibits the enforcement of foreign governing-law clauses, the preceding sentence will be read down to the minimum extent necessary to preserve the validity of these Terms.

Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
